Medical Misdiagnosis Claim UK

Medical Misdiagnosis Claims

We rely on healthcare professionals to utilise their knowledge and experience to diagnose and treat ourselves and our loved ones correctly. Unfortunately, a misdiagnosis can have life-altering consequences and even result in fatality. If you or a loved one has been mistreated or misdiagnosed, you may be in a position to bring proceedings and claim compensation.

There are several ways a misdiagnosis can take form:

Incorrect Diagnosis:

This may arise in situations where a healthcare professional diagnoses a patient with the wrong condition, resulting in a failure to identify the real source of the patient’s problems. This will be detrimental to patients who are provided treatment for a disease, illness or injury they don’t have.

Delayed Diagnosis:

Most illnesses tend to worsen if an early diagnosis does not identify the problem. For example, illnesses such as cancer or diabetes must be diagnosed as early as possible to ensure you receive the most effective treatment possible. In this context, any delay may be the difference between curative treatment and palliative care.

Failure to Diagnose:

A misdiagnosis can be identified where a healthcare professional has failed to detect signs of disease or illness, leaving a patient’s condition undiagnosed altogether. The result of a failure to diagnose may be a decline in the patient’s health, with long-term suffering and death also possible outcomes.

FAQs

I think I have a case – how long do I have to initiate a claim?

In the Republic of Ireland, you have a two year statutory timeframe from the date of incident to bring a case in medical negligence. For minors, the statutory timeframe begins on their 18th birthday.

What will I receive compensation for in a case of this nature?

Compensation will be awarded based on your current condition and prognosis as well as the extent of the injury suffered. Usually, compensation is awarded for example for psychiatric injury, physical injury, prolonged stay in hospital, requirement of further surgery, loss of amenity and reduction in quality of life and care costs.

How long will my case take to resolve?

Medical negligence cases are complex and require input from several different medical experts and advice from legal Counsel. A realistic timeframe for a medical negligence case would be ranging from two to four years.
