You are owed a legal duty of care by healthcare professionals. These professionals are also under obligation to uphold a certain standard of care.
Types of Illness and Disease Claims
Cancer treatment – The healthcare treatment for cancer in the Republic of Ireland is generally very good. However, there are occasions when treatment falls below an acceptable level which causes problems such as the cancer spreading or becoming untreatable. Common examples of negligence we have dealt with in relation to cancer claims include mistreatment, misdiagnosis, and delay in diagnosis. The nature of most forms of cancer means that they need to be identified as early as possible to be more easily treated. When there is an unacceptable delay in diagnosis it can often lead to preventable problems arising and the cancer worsening as a result.
Hospital Infections – This includes urinary tract infections, pneumonia, and surgical wound infections. Hospitals must have an enhanced level of hygiene to reduce the risk of patients contracting these types of infections.
Infectious Disease Claims - This can include diseases such as meningitis, septicaemia and, more recently, Covid-19. Hospitals will obviously be a hub for many infectious diseases. Medical staff therefore have a duty to take steps to contain the spread of infectious disease. Failure to do so could result in a claim of negligence.
Sepsis Claims – Sepsis is a potentially life-threatening condition caused by the body’s response to an infection. Sepsis occurs when the body’s response to the chemicals released into the bloodstream to fight infection are out of balance. This triggers changes that can damage multiple organ systems. If your sepsis was misdiagnosed, mistreated or there was a delay in diagnosis then you may be able to make a claim for compensation.
