Dental negligence covers a broad range of ways in which poor treatment can cause patient suffering.

This suffering may occur when there has been a failure to diagnose or treat oral cancers, infections and cysts, a lack of skill, or a failure to apply skill has been demonstrated with dental equipment such as drills, whereby the dentist has invited an unnecessary, possibly harmful or expensive procedure and finally where there has been a misapplication of anaesthetics, antibiotics, sedatives or analgesics.

Dental negligence may cause a great degree of discomfort and pain. This may take forms such as nerve damage, toothache or sensitivity. There is also a risk that dental negligence may cause infection in the gums or mouth more generally. This may lead to pain and swelling which may spread around the body if not treated. Dental negligence can result in psychological suffering through depression or anxiety.

FAQs

I think I have a case – how long do I have to initiate a claim?

In the Republic of Ireland, you have a two year statutory timeframe from the date of incident to bring a case in medical negligence. For minors, the statutory timeframe begins on their 18th birthday.

What will I receive compensation for in a case of this nature?

Compensation will be awarded based on your current condition and prognosis as well as the extent of the injury suffered. Usually, compensation is awarded for example for psychiatric injury, physical injury, prolonged stay in hospital, requirement of further surgery, loss of amenity and reduction in quality of life and care costs.

How long will my case take to resolve?

Medical negligence cases are complex and require input from several different medical experts and advice from legal Counsel. A realistic timeframe for a medical negligence case would be ranging from two to four years.
