How do I make an education-based claim?

All children in Ireland have the right to education from at least the age of 6 to 16. It is vital that these rights be protected, and unlawful breaches of these rights are appropriately challenged. This right is protected under the Irish constitution and in statute by the Education (Welfare) Act 200.

If you ask us to represent you, we will start by taking details of the event and assess what has happened and who is responsible. We will put together evidence in support of your case and contact the relevant educational authority to put them on notice of legal action.

If the other side admits liability, we will negotiate with them to agree on how the issue is to be resolved. Where they deny liability or the amount of remedy offered is not sufficient, your case will go to court. We will ensure that you have our support throughout and that you are represented by an expert education law advocate.

What is the time limit for bringing an education-based claim?

In the Republic of Ireland, the time limit for bringing an education-based claim is generally governed by the statute of limitations. For most civil claims, including those related to education, the standard limitation period is six years from the date the cause of action accrued. However, if the claim involves personal injuries, such as psychological harm due to inadequate supervision, the limitation period is two years from the date of knowledge of the injury.

For minors, the limitation period does not begin until they reach 18 years old, effectively extending the time limit until their 20th birthday. There are also provisions for cases where the damage or injury is not immediately apparent, allowing the limitation period to start from the date the damage or injury was discovered or ought to have been discovered with reasonable diligence.
