Mediation is not a mandatory process, and a person or party cannot be compelled to use mediation to resolve their dispute. Its purpose is to reach a mutually acceptable agreement to resolve the dispute outside of Court. Once a settlement has been written and signed that both parties have agreed to, it is as legally binding as any contract.
