Early Neutral Evaluation (ENE) is a process involving the appointment of an independent, neutral and impartial evaluator by parties involved in a dispute to provide an assessment of the merits of their respective cases. The evaluator can provide an authoritative although provisional view of the issues identified in the case and an experienced evaluation of the evidence at hand to address them.
ENE is useful for when a case reaches a stalemate on a particular element of their case, as well as for providing a quicker resolution process. It facilitates a more efficient strategy to diffuse disputes and highlight the limits of the case, from possible gaps in evidence to the risks involved in pursuing litigation.
ENE is flexible and confidential; however, it is also non-binding as it does not result in an official, legal decision. Ultimately, it is a useful form of dispute resolution that can clarify disputes be they factual, technical or legal.
